When you purchase products from the online store of Origami Group Limited (“Origami Labs”) you agree to be bound by these terms and conditions (“Terms and Conditions”) and any other terms we may supply, including but not limited to our Terms of Service (below) and our Privacy Policy
Please read the terms of sale before purchasing our products. When purchasing our products from our online store, you are accepting and agreeing to these terms and conditions. You are also representing and warranting that you are of sufficient legal age in your jurisdiction or place of residence to purchase and use our products. If you do not agree to these terms, do not purchase Origami Labs’ products. The products offered in our online store are not for resale. As you provide a payment card, you represent and warrant that you are authorized to use the payment and that you authorize Stripe the third party payment processing partner, to charge your payment card for the total amount of your order, including all applicable taxes and other charges. If the payment information you supplied is rejected or we cannot otherwise process your transaction, your order may be cancelled, suspended, or delayed. You bear the responsibility to resolve any payment problems that Origami Labs encounters while processing your order. If you wish to change your payment information, you can do so by emailing Origami Labs at hi@origami-labs.com.
All products offered on Origami Labs’ online store are subject to availability. Prices for our products are subject to change without notice, but such changes will not operate retrospectively on any order you have already placed.
Origami Labs reserves the right, without notice at any time, to modify or discontinue the service, and to impose quantity limits on any order, and to reject all or part of an order. Origami Labs shall not be liable to you for any modification, suspension or discontinuance of the service.
Prices for the products offered for sale on Origami Labs’ online store does not include shipping costs, except when otherwise specified. You are solely responsible for the delivery charges described on our online store or the relevant sites. Origami Labs and/or the freight carrier will only be responsible for any product loss that occurs when the product is in transit to you.
All safety warnings, information, instructions, packaging, in-box materials, mobile apps, and support services are provided only in English. You are responsible for complying with all applicable laws and regulations of the country for which the product is destined. We are not liable or responsible if you break any such law.
All sales are final. We accept returns or exchanges for product damaged in transit or if the incorrect product was shipped to you. You must email us within 7 days of receiving the product at support@origami-labs.com to alert us of the damaged or incorrect product, and then return the product to us. Upon receipt of the incorrect or damaged item we will ship out a replacement.
Origami Labs warrants that all products sold shall be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase, except that if you reside in the European Economic Area (EEA) and you purchased your Origami Labs product in the EEA, the warranty period is two (2) years from the date of purchase.
Origami Labs is not responsible for damage arising from failure to follow instruction relating the use of products. It is at your own discretion and risk to use Origami Labs’ products. You will be solely responsible for any and all loss, liability or damages resulting from your use of the products, including loss of life, personal injury, or the loss or damage to mobile device and other property.
This limited warranty is subject to several important restrictions:
By purchasing through the Origami Labs online store, you are deemed to give consent to the collection and use of certain personal information about you, as specified in the Privacy Policy.
Except to the extent prohibited by applicable law, Origami Labs shall not be liable for any incidental, indirect, special or consequential damages, including, without limitation, loss of profits, revenue or data, resulting from any breach of express or implied warranty or condition or under any other legal theory, even if Origami Labs has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This limitation is cumulative and will not be increased by the existence of more than one incident or claim. Origami Labs disclaims all liability of any kind of Origami Labs’ Licensors and Suppliers.
Origami Labs controls and operates this online store from its headquarters in Hong Kong. All matters in any way relating to your use of the products or these Terms and Conditions, shall be governed and construed by the laws of Hong Kong Special Administrative Region. You agree to submit to the exclusive jurisdiction of the Hong Kong courts.
Any claim under these Terms and Conditions must be filed within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be brought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy with or dispute between Origami Labs and you arising out of or in connection with your use of the Online store, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If Origami Labs is not able to resolve any such dispute within a reasonable time, that is, not exceeding thirty (30) days, then either party may submit the controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available under applicable law.
Origami Labs is not responsible for anything that we may otherwise be responsible for, if it is the result of events beyond our reasonable control, including but not limited to, acts of God, insurrection, riots, terrorism, crime, labour shortages, embargos, postal disruption, communication disruption, failure or shortage of infrastructure, shortage of materials, or any other events beyond Origami Labs’ control.
If a provision of these Terms and Conditions is found to be unlawful, conflicting with another provision of the Terms and Conditions, or otherwise unenforceable, the Terms and Conditions will remain in force as though it had been entered into without that unenforceable provision being included in it. Origami Labs shall have the sole right to elect which provision remains in force if two or more provisions of these Terms and Conditions are deemed to conflict with each other’s operation.
Origami Labs reserves all rights permitted to us under these Terms and Conditions as well as under the provisions of any applicable law. Our non-enforcement of any particular provision or provisions of these Terms and Conditions or the any applicable law should not be construed as our waiver of the right to enforce that same provision under the same or different circumstances at any time in the future.
You may not assign your right and/ or obligations under these Terms and conditions to any other party without Origami Labs’ prior written consent. Origami Labs may assign our rights and/ or obligation under these Terms and Conditions to any other party at our discretion.
We may amend this Agreement from time to time. When we amend this Agreement, we will update this page and indicate the date that it was last modified, make an announcement on our homepage or we may email you. You may refuse to agree to the amendments, but if you do, you must immediately cease using our App, Site and Services.
The communications between you and Origami Labs use electronic means, whether you use the ORII mobile application, or visit the Site, or send us e-mails, social media, or other messages, or whether Origami Labs posts notices on the mobile app, Site, or Service or communications with you via e-mail, or social media. For contractual purposes, you (1) consent to receive communications from Origami Labs in an electronic form; (2) agree that all terms, conditions, agreements, notices, disclosures, and other communications that Origami Labs provides to you electronically satisfy any legal requirement that such communications would satisfy if it were to be in writing. The foregoing does not affect your statutory rights.
